1. Acceptance of Terms

By accessing or using Cleare (cleare.app) ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Splintara OÜ ("Company", "we", "us").

2. Nature of the Service — Entertainment Disclaimer

Cleare is an educational entertainment platform. All content — including synastry profiles, compatibility analyses, relationship insights, daily cards, and educational modules — is provided for entertainment and general educational purposes only.

The Service does not constitute, and must not be relied upon as, professional psychological, psychiatric, therapeutic, medical, legal, financial, or any other professional advice. Synastry and birth chart analysis are forms of entertainment and personal reflection, not science. We make no representations or warranties regarding the accuracy, reliability, or applicability of any analysis or content to your specific circumstances.

Any decisions you make in reliance on content from the Service are made entirely at your own risk. Always consult a qualified professional for advice relevant to your specific situation.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement. The Service is not intended for persons under 18.

4. Account Registration

To access premium features you must create an account. You agree to: (a) provide accurate and complete information; (b) keep your credentials secure; (c) not share your account with others; (d) notify us immediately at support@cleare.app of any unauthorised use. You are responsible for all activity that occurs under your account.

5. Subscriptions and Payments

5.1 Plans

We offer a paid trial and recurring subscription plans (Weekly, Monthly, Yearly) as described on our pricing page. All prices are in USD and include applicable taxes unless stated otherwise.

5.2 Billing

Subscription fees are billed in advance on a recurring basis. By subscribing, you authorise us (via our payment processor) to charge your payment method on each billing date until you cancel.

5.3 Cancellation

You may cancel your subscription at any time via the cancel subscription page or by contacting support. Cancellation takes effect at the end of the current billing period; access continues until then. No partial refunds are given for unused periods except under our 30-day money-back guarantee.

5.4 Price Changes

We may change subscription prices on 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.

6. Refunds

We offer a 30-day money-back guarantee on all paid plans. See our Refund Policy for full details. The $0.99 trial fee is non-refundable after the trial period expires unless required by applicable law.

7. Intellectual Property

All content on the Service — including text, graphics, logos, illustrations, code, and educational content — is owned by or licensed to Splintara OÜ and protected by copyright and other intellectual property laws. You may use the Service content for personal, non-commercial purposes only. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.

8. User Conduct

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse engineer, decompile, or hack the Service; (c) use automated tools to access or scrape the Service; (d) impersonate any person or entity; (e) upload or transmit malicious code; (f) interfere with the operation of the Service.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPLINTARA OÜ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Splintara OÜ from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia and, where applicable, EU law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, unless you are a consumer with rights under mandatory local law in your country of residence. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or notice on the Service at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance. If you do not accept the changes, you must stop using the Service and may request a refund under our Refund Policy.

15. Termination

We may suspend or terminate your account if you breach these Terms, upon written notice. You may close your account at any time by contacting support@cleare.app.
